How to buy a land in India for constructing a building?
Verify if the Deed title is under the name of the seller or if it also has the co owner. This will help to understand if the seller has the full right to sell it or not. Ask for the original but not a photocopy.
To check if the land is free from any legal hassle and unpaid dues, get the Encumbrance Certificate from the Sub-registrar's office for the last 30 years.
Ask for the original Property Tax Receipts and Bills.
Release Certificate: This is valid only while buying a resale property. The concerned bank or the lender has to state that the loan on the land has been completely repaid.
Find out if the land is agricultural or non-agricultural. Buy the land according to the specific usage of the building. NA (Non-Agricultural) primarily encompasses residential, commercial and industrial properties. If the land is not registered under the category that you need, then it is mandatory to obtain orders from the Town Planning Authority permitting for the change of land use.
Ensure that the land has all the requisite approvals from local authorities declaring all-clear on the plot of land.
Check the dimensions of the plot. You can also get the help of the surveyor.
Find out if the land is flat or on a slope. The cost of the construction is more if it is sloped and it could reduce your chances of getting required sunlight.
Usually, if you buy a corner plot, a portion of the plot would be used for laying the road.
The Floor Space Index of the land determines the ratio of construction that could legally take place on the land. Judge the price of land only after knowing about FSI but not just the total area.
Find if there are arrangements for basic amenities, like water, electricity and access to the main road, etc,. Estimate the plot’s Annual Maintenance Charges. This helps to invest in a plot that will offer good returns and less trouble in the future.
Get the Sale Agreement, which typically covers the following:
Particulars of the land,
The total cost agreed between seller and buyer,
The advance amount by the buyer,
The actual sale period that should take place,
Cancellation Claus.
The agreement of sale document just states that the seller and buyer have agreed to the terms and conditions for the deal. But to get legal proof of sale, you need the Sales Deed. Transfer to the buyer's name with the help of a Government licensed Document writer.
Get the receipt from payment of stamp duty.
The State Municipality Act requires prior sanction to undertake construction activity of a new building or to modify an existing one.
